These Terms of Use and Terms of Sale govern access to and use of the MouthCare service, as well as subscription to the practitioner plan. By creating an account or using the service, you accept these terms in full.

1. Purpose

MouthCare, published by NT CORPORATION (see legal notice), is an online service (SaaS) for dentists and their practice. It delivers a remote pre-consultation (reason for visit, questionnaire, guided photos, artificial intelligence analysis) as a structured record before the appointment, and supports follow-up and advice for the patient. MouthCare includes a free patient mobile app and a practitioner workspace available on subscription.

2. Definitions

  • Service: the mouthcare.fr website, the practitioner workspace and the MouthCare mobile app.
  • Practitioner: the dentist or the practice holding an account and a subscription.
  • Patient: the user of the mobile app or of the pre-consultation link.
  • Pre-consultation: the record completed by the patient before their visit (reason for visit, pain, symptoms, photos).
  • Subscription: paid access to the practitioner workspace.

3. Acceptance and changes to these terms

Using the Service means accepting these terms. NT CORPORATION may amend them at any time; users are informed of substantial changes, and continued use means acceptance of the version in force, available on this page.

4. Description of the service

The Service allows, in particular:

  • sharing a pre-consultation link / QR code with the patients of the practice;
  • collecting the reason for visit, the pain level, the symptoms and guided intra-oral photographs;
  • obtaining an AI analysis that returns areas to monitor and probability scores;
  • reviewing structured records, sorted by priority (urgent, routine, check-up), in the practitioner workspace;
  • offering the patient, through the app, hygiene advice and follow-up linked to the symptoms reported.

5. Practitioner account

Creating an account requires accurate information (identity, practice, contact details). The Practitioner is responsible for keeping their credentials confidential and for any activity carried out from their account. The Service is reserved for authorised healthcare professionals; the Practitioner warrants that they hold the qualifications and authorisations required to practise.

6. Patient app (free)

The patient mobile app is free and optional. The patient can complete their pre-consultation through a simple link, without installing the app. Use of the app is subject to these terms and to the privacy policy.

7. Nature of the service — information, not a medical conclusion

MouthCare's AI analysis is undergoing qualification as a Class IIa medical device (CE marking in progress). It provides support in preparing the consultation and flagged areas with a probability score. It is not a medical conclusion, it does not replace a consultation, and the clinical decision rests exclusively with the practitioner: the AI flags, the practitioner decides. The urgency alert is triggered from the questionnaire completed by the patient.

8. User obligations

Each user undertakes to:

  • use the Service fairly and in accordance with the law and its healthcare purpose;
  • not misuse or disrupt the Service, nor attempt to access it fraudulently;
  • provide accurate information and only upload content they have the right to share;
  • respect professional secrecy and patients' rights (obtaining consent).

9. Intellectual property

MouthCare, its brand, its interfaces, its code and its AI models remain the exclusive property of NT CORPORATION. The subscription grants a personal, non-exclusive and non-transferable right of use, limited to the term of the subscription. The data and photographs sent by the patient remain the property of the patient / the practice.

10. Personal and health data

Data processing is described in the privacy policy. Health data is hosted with Google Cloud, an HDS-certified (French health-data hosting) provider, within the European Union. On behalf of the practice, NT CORPORATION acts as a processor within the meaning of the GDPR; a data processing agreement (DPA) is provided on request.

11. Availability and maintenance

NT CORPORATION uses reasonable means to keep the Service available but does not guarantee uninterrupted operation. Maintenance work or incidents may cause temporary interruptions.

12. Liability

The Service is a tool that supports preparation and follow-up; the practitioner remains solely responsible for their clinical decisions and procedures. Within the limits permitted by law, NT CORPORATION's liability is limited to direct and proven damages, and capped at the amounts paid under the subscription over the last twelve months. NT CORPORATION cannot be held liable for any use of the Service that does not comply with these terms.

13. Subscription and pricing

Access to the practitioner workspace is offered at €23 per month including VAT, per practice, with practitioners and pre-consultations included. The first six months are free, with no payment card. Prices may change; any change is notified in advance and applies from the following renewal.

14. Free period

The Service is made available free of charge for six months from account creation, with no payment card. At the end of that period, paid access is activated only after the Practitioner explicitly subscribes: no automatic switch takes place and no payment can be taken without their agreement. Without a subscription, access ends, export of their data remaining guaranteed under the conditions set out in article 11.

15. Payment and renewal

After subscribing, the subscription is monthly, with no minimum term, payable in advance by payment card through our secure payment provider. It is automatically renewed each month until cancellation. An invoice is made available in the practitioner workspace.

16. Cancellation

The Practitioner can cancel at any time, in one click, from their workspace. Cancellation takes effect at the end of the current monthly period; access remains open until then and no refund is due for a period already started. During the six free months, closing the account takes effect immediately and at no cost. No penalty applies.

17. Right of withdrawal

The practitioner subscription is taken out by a professional as part of their business activity: the 14-day right of withdrawal available to consumers (art. L.221-18 of the French Consumer Code) does not apply. The six free months, with no payment card, nevertheless let the Practitioner try the Service with no commitment and at no cost.

18. Suspension or termination by MouthCare

In the event of a breach of these terms, fraudulent use, non-payment or a security threat, NT CORPORATION may suspend or terminate access, after informing the user where possible.

19. Complaints and dispute resolution

Any complaint can be sent to contact@mouthcare.fr. As the service is aimed at professionals, the arrangements for amicable dispute resolution (free recourse to the Médiateur des entreprises, the French business ombudsman) are set out in the legal notice.

20. Governing law and jurisdiction

These terms are governed by French law. Failing an amicable resolution, the French courts have sole jurisdiction.
