This policy explains which data MouthCare collects, why, how we protect it, and the rights you have. It applies to the MouthCare mobile app and to the mouthcare.fr website.
1. Data controller
The controller of your data is NT CORPORATION, the company that publishes MouthCare, with its registered office at 3 avenue de Verdun, 69570 Dardilly, France, represented by Dr Romain Lateur, dentist.
For any question about your personal data: contact@mouthcare.fr.
2. The data we collect
Account data
First name, surname, phone number, email address and password (encrypted), when you create an account.
Oral health data
Photographs of your mouth, reason for visit, self-reported pain level, symptoms, and the results of the analysis (probability scores, areas to watch, guidance). This information constitutes health data, a special category under Article 9 of the GDPR, processed only with your explicit consent.
Location data
If you use the "find a practice" feature, your approximate location is used, at your request, to show you nearby dentists. It is not retained for that purpose.
Technical and usage data
Device type, operating system, technical identifiers and connection logs, required for the operation, security and improvement of the service.
3. Why we use your data (purposes & legal bases)
- Running the pre-analysis and giving you guidance — legal basis: your explicit consent (health data).
- Creating and managing your account — legal basis: performance of the contract (our terms of use).
- Helping you find a dental practice — legal basis: your consent (location).
- Ensuring security, preventing fraud and improving the app — legal basis: our legitimate interest.
- Answering your support requests — legal basis: your consent or our legitimate interest.
4. Artificial intelligence analysis
MouthCare uses a computer vision model to analyse your photos and estimate probabilities (calculus, caries, gingivitis and similar signs). These results are informational and are neither a medical conclusion nor an automated individual decision producing legal effects concerning you. They do not replace a consultation with a dentist: the AI flags, the practitioner decides.
5. Who has access to your data
Your data is never sold. It is accessible to authorised MouthCare staff, and to technical providers (processors) acting on our instructions and under contract, in particular:
- an HDS-certified health data host (French health-data hosting) for secure storage;
- cloud infrastructure, database and authentication providers;
- a mapping provider for the practice search.
If you book an appointment, the necessary information may be passed on to the dental practice you choose.
6. Transfers outside the European Union
Some providers may process data outside the EU. Where that is the case, these transfers are covered by appropriate safeguards (European Commission standard contractual clauses or equivalent mechanisms).
7. Retention period
We keep your data for as long as your account is active. Your analyses and photos are kept so that you can track how they change over time, then deleted or anonymised when your account is closed, unless a legal retention obligation applies. You can request their deletion at any time (section 8).
8. Your rights
Under the GDPR, you have the following rights:
- right of access to your data;
- right to rectification;
- right to erasure (the "right to be forgotten");
- right to restriction of and objection to processing;
- right to data portability;
- right to withdraw your consent at any time, without affecting processing already carried out;
- right to set instructions on what happens to your data after your death.
To exercise these rights, write to us at contact@mouthcare.fr. You may also lodge a complaint with the CNIL (the French data protection authority, www.cnil.fr).
9. Security
We implement appropriate technical and organisational measures (encryption of data in transit, access control, secure hosting) to protect your data against unauthorised access, loss or alteration.
10. Minors
The app is not intended for children under 15 without the consent and supervision of a holder of parental authority.
11. Cookies (website)
The mouthcare.fr website uses cookies that are strictly necessary for it to work and, where applicable, audience measurement cookies subject to your consent. You can manage your preferences from your browser.
12. Changes
We may update this policy. If a significant change is made, we will inform you through the app or the website. The date of the last update appears at the top of this page.
